New “Sandbox” law for AI innovation?

US Senate Commerce Chair, Ted Cruz, has proposed a new AI bill that, if passed by Congress, would require federal governments to build "regulation sandbox environments,” which are safe and secure testing areas, that would allow companies to experiment with new AI products, with minimal federal oversight. Cruz’s proposal comes after his own state of Texas passed a similar AI sandbox law back in June.

🔓 Key Points

  • If passed, the law would enable companies to identify “obstructive regulations” that would slow the testing or deployment of new AI-powered products/services and ask for regulation modifications or waivers.

  • Federal agencies would be able to issue waivers for two-year-periods, for a maximum of 10 years, and in return for the waiver, companies would be required to provide plans to mitigate any potential safety risks.

  • If the federal agency rejects a waiver request, companies can appeal to the White House Office of Science and Technology Policy (OSTP), which will oversee the program and have the ability to override the decision.

🔐 Relevance

Cruz’s proposed legislation comes as many lawmakers (including Cruz) are growing increasingly concerned that too much regulation around AI will stifle growth and innovation, causing them to fall behind the likes of China in AI progress. He believes this bill will be essential for driving innovation and maintaining the USA’s leadership in AI, as it will “cut through bureaucratic red tape, and empower American AI developers.” However, many consumer advocacy and technology accountability groups fear that the bill will only favor major tech companies, like OpenAI, Meta, and Google, calling it a “sweetheart deal for Big Tech CEOs,” as it will mean one set of rules for them and another for smaller start-ups.

  • Basically, the project’s objective is to understand what causes “randomness” in AI model responses. For instance, if you ask ChatGPT the same question multiple times, you’re likely to get different answers.

  • Murati’s researchers believe that the AI models’ unreliability is caused by how AI chips are “stitched together,” which is a fixable issue, meaning AI models will be able to deliver more reliable responses.
